Having a psychiatric disorder or developmental disorder that affects cognitive or emotional functions to the extent that one’s capacity for judgment and reasoning is significantly diminished. Depending on setting and context, this may also include persons who are under the influence of a substance or substance dependent, suffering from degenerative diseases affecting the brain, terminally ill, or who are affected by severely disabling physical handicaps.
